1. Introduction

This is the Privacy Notice of The Producer Register Limited, which is referred to as the “Company”, “us” or “we” throughout this Privacy Notice. This Privacy Notice provides details of the way in which we process personal data in line with our obligations under applicable data protection law, including Regulation EU No. 2016/679 General Data Protection Regulation (“GDPR”). 

Personal data means any information through which a natural person is identified or identifiable. This Privacy Notice addresses data subjects as “you” and applies to all methods and purposes for which we collect third party personal data (excluding the personal data of our staff), whether through our website, registration forms or otherwise.

2. Background and Purpose

The purpose of this Privacy Notice is to explain what personal data we process and how and why we process it. In addition, this Privacy Notice outlines our duties and responsibilities regarding the protection of such personal data and the rights of data subjects in relation to our processing of their personal data. The manner in which we process personal data will evolve over time and we will update this Privacy Notice from time to time to reflect changing practices. To the extent that any changes to this Privacy Notice are material, the Company will use reasonable endeavours to bring such changes to your attention. 

3. The Company as a Data Controller

The Company acts as the “Registration Body” under S.I. No. 400/2017 - Waste Management (Tyres and Waste Tyres) Regulations 2017, as amended, S.I. No. 283/2014 - European Union (Batteries and Accumulators) Regulations 2014 and S.I. No. 149/2014 - European Union (Waste Electrical and Electronic Equipment) Regulations 2014, (together, the “Regulations”) and have approval from the Minister for Communications, Climate Action and Environment (previously the Minister for Environment, Community and Local Government) to perform the functions of the Registration Body under the Regulations, which include the registration of producers of electrical and electronic equipment, batteries, accumulators and tyres (“Producers”) in Ireland.

The Company is the controller of personal data we process in connection with the operation and administration of the Company and the fulfilment of our statutory functions under the Regulations. 

4. How, why, and on what basis we process personal data

Personal data will be provided directly to us by certain individuals in connection with the operation and administration of the Company and the fulfilment of our statutory functions under the Regulations. Such individuals will generally include the following:

  1. website visitors; and
  2. Producers, and employees or representatives of Producers.

  • Contact details, such as address, email address and telephone number of the Producer. 
  • Communication information, such as copies of previous email and other correspondence with Producers (where that Producer is a natural person) or employees or representatives of Producers.
  • Payment and bank account information of Producers, where that Producer is a natural person.

To maintain an accurate and up to date register of producers of EEE, batteries, accumulators and tyres and fulfil the Company’s other statutory functions pursuant to the Regulations. 

The processing is necessary for compliance with a legal obligation (pursuant to the Regulations to establish and maintain a register of Producers placing electrical and electronic equipment on the market in Ireland).

5. Data Subject Rights

As a data subject in the EEA, you have certain rights under applicable data protection laws. These include:

  1. the right to receive detailed information on the processing of your personal data; 
  2. the right to request access to a copy of your personal data (commonly known as a “data subject access request”); 
  3. the right to correct any inaccuracies in your personal data;
  4. the right to request erasure personal data (commonly known as the “right to be forgotten”); 
  5. the right to request the restriction of processing of your personal data; 
  6. the right to request your personal data in a format that makes it easier to reuse in another context, and to request the transfer of your personal data to another party, where technically feasible;
  7. the right to object to processing of your personal information where we are relying on our legitimate interests (or those of a third party) on grounds that are personal to you. You also have the right to object where we are processing your personal data for direct marketing purposes. We do not use personal data for direct marketing purposes.
  8. the right to not be subject to automated decision making, including profiling. Automated decision-making takes place when an electronic system uses personal information to make a decision without human intervention. We do not routinely carry out automated decision making and in the event that we were to do so we will make you aware and provide you with the relevant information regarding this at the time; and
  9. the right to make a complaint with the competent data protection supervisory authority, which in Ireland is the Irish Data Protection Commission. While you are not required to by law, we ask that you contact us at the email address listed below in the first instance to give us the opportunity to address any concerns that you may have. 6. Failure to provide personal data

In certain circumstances, the Company has statutory obligations to process personal data relating to you. In the event that you refuse to provide such personal data to the Company, the Company may not be able to complete effective registration of your details as a Producer, which could place you in breach of the provisions of the Regulations and could result in prosecution or other penalties against you by the relevant statutory authorities.

7. Data Security

The Company will hold personal data securely and in accordance with Data Protection Law. We have technical and organisational measures in place to protect personal data from unlawful or unauthorised destruction, loss, change, disclosure, acquisition or access. 

8. Sharing personal data with third parties

From time to time, we may disclose personal data to third parties, or allow third parties to access personal data which we process. This may include sharing the personal data of Producers, and/or employees or representatives of Producers with the Minister for Communications, Climate Action and Environment and members of the Department of Communications, Climate Action and Environment, and with the Environmental Protection Agency, pursuant to our obligations under the Regulations, including where there is evidence that a Producer is not in compliance with the Regulations.

We may also disclose personal data to other selected third parties such as service providers who assist us in managing the website, hosting or otherwise storing our data, accountants, legal advisors, consultants and other professionals, financial institutions. We may also share personal data with other statutory or State agencies (including law enforcement bodies), where required or permitted to do so by law.

9. Data Retention

We will keep personal data only for as long as the retention of such personal data is deemed necessary for the purposes for which that personal data are processed (as described in this Privacy Notice) or by reference to certain statutory requirements or investigations. 10. Data Transfers outside the EEA

The Company does not routinely transfer personal data to countries outside the EEA which do not have the same or equivalent Data Protection Law as Ireland and any such transfers outside the EEA shall be subject to the required protections under Data Protection Law, further details of which are available by contacting us.

Cookies are small text files that provide information regarding the device used by a visitor. Where used, cookies are downloaded to your device and stored on your device.
